services, text messaging program, and tours. Houston Pedal Barge is operated by Lone Star Kayak Tours LLC (“Houston
Pedal Barge,” “we,” “us,” or “our”). By booking a tour, using our website, or opting in to our text messages, you
agree to these Terms.

1. SMS / Text Messaging Terms

By providing your mobile phone number and opting in, you consent to receive text messages from Houston Pedal
Barge. This may include booking confirmations, trip reminders, customer service replies, and promotional offers.

We will not sell, rent, or share your mobile phone number or text messaging consent with third parties or

All tours must be reserved in advance through our booking system. Prices are listed per person and are subject to
change. Payment is due at the time of booking. You are responsible for providing accurate booking information,

3. Cancellations and Refunds

Cancellation and refund terms are presented during the booking process and in your confirmation. In general:

• Cancellations made with sufficient advance notice may be eligible for a refund or reschedule, as stated in
  your booking confirmation.
• We may cancel or reschedule a tour due to weather, water conditions, mechanical issues, insufficient bookings,
  or safety concerns. If we cancel, you will be offered a reschedule or a refund.
• Our vessels have a roof and operate in light rain. Rain alone is generally not a reason for cancellation.

4. Tour Rules and Safety

For everyone’s safety, guests agree to follow all instructions from our captains and crew. Age, weight, and
capacity restrictions apply and are described at the time of booking. We reserve the right to refuse service to, or
remove from a tour, any guest who is intoxicated to the point of being unsafe, disruptive, or who fails to follow crew
instructions, without refund.

5. Assumption of Risk and Waiver

Participation in a pedal barge tour or any on-water activity involves inherent risks, including risks associated
with watercraft, weather, and the water environment. By booking and participating, you acknowledge and voluntarily
assume these risks for yourself and any guests in your party. A separate liability waiver may be required before
boarding, and the terms of that waiver apply in addition to these Terms.

6. Limitation of Liability

To the fullest extent permitted by law, Houston Pedal Barge and Lone Star Kayak Tours LLC, including their
owners, employees, and contractors, shall not be liable for any indirect, incidental, or consequential damages arising
from your use of our website, booking services, text messaging program, or tours. Our website and services are
provided on an “as is” basis without warranties of any kind.

7. Privacy

We collect and use personal information, including contact details and mobile phone numbers, to operate our
